Abstract Based on a survey administered in 13 prisons in England & Wales and Norway, as part of a research programme with explicitly comparative aims, this article seeks to address both the relative and absolute dimensions of the Nordic penal exceptionalism thesis. It outlines the consistently more positive results in Norway compared to England & Wales, explaining them primarily with reference to the former’s much higher quality and use of open prisons. Abstract The association between attention-deficit hyperactivity disorder (ADHD) and criminality has been increasingly recognized as an important societal concern. Life imprisonment without prospect of release is a penalty experiencing remarkable success today, especially in Europe. However, certain human rights bodies have recently begun to assert that this penalty runs counter the so-called ‘right to hope’, derived by way of interpretation from the right not to be subject to inhuman or degrading treatment. The purpose of the present contribution is to shed light on the potential and the limits of such trend by analyzing the case-law of universal (such as the UN system) and regional (the European system, the Inter-American system; the African system) bodies.

The possibility to achieve successful resocialization of former prisoners back into society is an ongoing public debate, making it challenging for policymakers to implement prisoner rehabilitation programs capable of maintaining the public safety while allocating public funds in the most efficient way. Wykonywanie kary pozbawienia wolności związane jest z izolowaniem skazanych w zakładach karnych odpowiedniego typu. Warunki w zakładzie typu zamkniętego zostały tak określone, że prawa skazanych ograniczono głównie ze względu na konieczność utrzymania ładu i porządku wewnętrznego.
