Prevention of Violence against Children and Psychosocial Models of Intervention: Network Analysis of an Inter-Institutional Service

This study describes an Italian service, the Inter-institutional Groups Operating against child Abuse and Maltreatment (GOIAM), which specializes in the treatment of child abuse. The GOIAM service is composed of 53 professionals divided into four different categories: social workers, psychologists, child neuropsychiatrists, and psychopedagogists. With the aim of detecting strengths and weaknesses of the operative model adopted by GOIAM, the whole service was analyzed through the application of social network analysis (SNA). Policies adopted by the governance of the EMU during the financial and Covid crises display a clear gap between the “form” and the “substance” of the institutional architecture of title VIII of the TFEU. It is submitted that this architecture is in sharp contrast with the European constitutional tradition. Furthermore, the traditional view is rejected, according to which the EU Commission and Council, as well as the ECB, are devoid of binding powers in the field of economic policy. Some reflections concerning both methodological implications of the foregoing and its possible effects on the European integration process are finally developed

Settore IUS/17 - Diritto PenaleThe paper analyses the offence of unlawful work intermediation and exploitation offering a comparative analysis with the German punitive system. The study focuses in particular on the limits of legitimacy of criminal law in the punishment of gangmaster acts in the attempt to avoid that the punitive intervention in economic and contractual dynamics of a mutual nature could be so intrusive to be in contrast with the principle of subsidiarity. To this end the author suggests an interpretative perspective that centres the penal disvalue of the offence under article 603-bis of the criminal code on the harm to fundamental workers’ rights – as linked to articles 4 35 and 36 of the Italian Constitutions – which work as a limit to entrepreneurial freedom. To be sure the indexes of exploitation listed by the criminalising norm seem to echo those fundamental human rights attributed to a person as a worker: those very same rights that – when harmed in their minimal and therefore intangible dimension – legitimise the intervention of the ius terribile. The article also stresses the protection of the job market: in this sense the offence – even if situated within the Kernstrafrecht – represents a new paradigm of the institutional response within the framework of the contemporary relationships between law and economics.

Constitutive Rules: The Symbolization Account

Our aim is to provide an account of constitutive rules in terms of (1) the acceptance of regulative norms, and (2) a cognitive process we call “symbolization” (in an altogether different sense from what J. R. Searle means by this word). We claim, first, that institutional facts à la Searle boil down to facts concerning the collective acceptance of regulative norms in a given community. This, however, does not exhaust what institutional facts are. There is a residue, symbolization. Abstract. Sources and Boundaries of Institutional and Linguistic Normativity. Towards a Critical Social Ontology.

The talk explores the problem of how it is possible to rationally judge an institutionally justified act if, from Hegel to contemporary social ontology, we accept that human reason is necessarily embedded in particular lifeforms and institutional settings. The talk argues that there is a specific, moral criterion of fairness built in every institutional and communicative act, which requires us to respect human dignity in each one of our institutional or communicative acts, and that this criterion can be justified through a linguistic, deflationary reinterpretation of Kant's categorical imperative of universalization of reasons for action.

Il ruolo della cartella clinica ai fini della valutazione della qualità per l'accreditamento istituzionale

The authors carried out research aimed at evaluating the quality of some aspects of a sample of medical records compiled in the operational uniti of a hospital. A subjective evaluation criterion was used, quantified by attibuting a correct numeric value by means of a weightingdeliberation factor. None of the medical record examined were judget qualitatively excellent. The main fact missing was the documentation regarding consensus, even in those medical records judget good or sufficient.
