Hans J. Morgenthau´s Turn from International Law to International Relations: A transition affected by History

2018

Analysis of Pakistan’s policy towards Afghan refugees: a legal perspective

2021

Pakistan hosts to the world's largest single population of Afghan refugees. However, despite Pakistan's long-standing acknowledgment of Afghan refugees, their legal status remains unclear. This is due to Pakistan's refusal to sign either the 1967 Protocol Relating to the Status of Refugees or the United Nations Convention Relating to the Status of Refugees (also known as the Geneva Convention). This paper investigates whether Pakistan's approach against Afghan refugees is in accordance with international law and human rights principles. Moreover, this paper seeks to provide a comprehensive response to the above question by highlighting the many difficulties that Afghan refugees have encount…

2020

The thesis focuses on the main international legal aspects of the annexation by one State, namely the Russian Federation, of a part of another sovereign State, Ukraine. The peaceful coexistence of States and various nationalities within the European Union, the United States, Asia and the Middle East is now under threat. The legal consequences of the August 2008 Russian-Georgian military conflict: how does the "creeping occupation" carried out by Russia violate Georgi…

2017

The present thesis illustrates how the "creeping occupation" violates Georgia’s territorial integrity and fundamental human rights based on the historical, as well as the 2008 and subsequent developments. Stemming from the current political events, the number of IDPs is a big problem across the world. All this is stipulated by very common international or non-international conflicts that are happening in today's world. These conflicts also include the problems of people internally displaced from the occupied territories in Georgia.

Rilevazione, creazione, resistenza: l'opinione separata e il diritto internazionale

2022

Separate opinions have made the object of extensive scholarship in recent decades: in the international legal order, this is a consequence of that institution’s peculiar success, as virtually all judiciary and quasi-judiciary bodies allow for the allegation of separate opinions (either concurring or dissenting) to their rulings. This contribution tests the impact of separate opinions on subsequent case law and opinions, on the process of international law-making, and eventually on the mechanisms through which the Italian legal order adapts to international law as interpreted by international judiciary or quasi-judiciary bodies. The practice under scrutiny is admittedly multifarious; yet, it…

Contratto e diritto internazionale

2002
