Human Rights in Romanian Courts: A European Perspective?
2016
The perception and application of the European Convention on Human Rights by various national jurisdictions depends fundamentally on the way in which the Convention has been introduced into national law, as well as, in some countries, by how constitutional jurisdictions shaped this relationship. The article examines the reception of the Convention by a few European states, with a special regard on the case of Romania. Romanian courts, including the Constitutional Court and the supreme court, had a hesitant approach of the principle established by 1991 Constitution of the priority of international law of human rights over domestic law. In the context of the diversity of sources of the Europe…
Introduction: Why (Ever) Define Law and How to Do It
2016
This contribution addresses some problems regarding the two core aspects of Schauer’s proposal discussed by his critics in this book: the method of defining law (his proposal of anti-essentialism) and the definition of law based on the ubiquity of coercion. In this introduction, both aspects will be discussed pushing to the very limit the idea of law as a differentiated phenomenon. This means that legal theory has to take non-state law seriously. But main legal theories in the Nineteenth century are biased by the domestic assumption: law is produced by the nation-state as a coherent and rational system identified by its pedigree and supported by the state’s raw force. According to this idea…
Between Criminalization and Protection. The Italian Way of Dealing with Migrant Smuggling and Trafficking within the European and International Conte…
2019
This volume is devoted to the dark side of human mobility, that is migrant smuggling, and, linked with it, human trafficking. Both subjects will be mainly treated from an Italian perspective; however, due to their having a generally transnational character, the analysis will necessarily require that international and supranational actions/measures also be taken into account. Moreover, the legal perspective will be supplemented by the phenomenological/criminological one, through which the authors try to provide the work with a realistic dimension aimed at grasping the practical aspects of both migrant smuggling and human trafficking emerging from the different ways in which such crimes are d…
The protection of cultural heritage and the role of culture in promoting European integration
2019
This article analyzes the legal protection of cultural heritage and the role of cultural heritage in promoting European integration. From a legal perspective, the notion of culture stems from the preamble of the UNESCO Universal Declaration on Cultural Diversity and is considered as a fundamental norm; however, cultural rights have been an overlooked and often ignored category of human rights for decades. The article thus aims at studying such a complex legal issue both from the perspective of International Law as well as under European Law in order to understand the way culture fosters integration within the European Union.

The use of armed drones for counter-terrorism purposes: whether customary international law?
2019
The vast and rapid development of technologies constantly creates gaps in the law within both the international and national law systems. One of such technologies the increased usage of which for military purposes has instituted a debate on the applicable law for its use under the existing legal frameworks is the technology of armed drones, also known as armed unmanned aerial vehicles (AUAVs). The source of the debate is the presumption that armed drones are almost exclusively used for counter-terrorism purposes, thus involving their use against non-state actors operating in a country that a state is not in war with. The author of this thesis will, first of all, identify the established leg…
Haiti has emerged as a factor of regional instability that led to its consideration by the United Nations Security Council as a threat to peace …
