This contribution addresses some problems regarding the two core aspects of Schauer’s proposal discussed by his critics in this book: the method of defining law (his proposal of anti-essentialism) and the definition of law based on the ubiquity of coercion. In this introduction, both aspects will be discussed pushing to the very limit the idea of law as a differentiated phenomenon. This means that legal theory has to take non-state law seriously. The protection of cultural heritage and the role of culture in promoting European integration

This article analyzes the legal protection of cultural heritage and the role of cultural heritage in promoting European integration. From a legal perspective, the notion of culture stems from the preamble of the UNESCO Universal Declaration on Cultural Diversity and is considered as a fundamental norm; however, cultural rights have been an overlooked and often ignored category of human rights for decades. The article thus aims at studying such a complex legal issue both from the perspective of International Law as well as under European Law in order to understand the way culture fosters integration within the European Union.

En este trabajo se presenta la concepción tripartita del derecho romano, se analizan sus fuentes y se demuestra su influencia posterior. El texto de referencia es el Corpus Iuris justinianeo, especialmente las Institutiones. La influencia de esta obra en pensadores como Isidoro de Sevilla, Francisco de Vitoria y Francisco Suárez confirman la proyección de la distinción ius naturalis, ius civilis y ius gentium hasta la Edad Media.
