Il dovere di soccorso in mare e il diritto di obbedire al diritto (internazionale) del comandante della nave privata
2019
Shipmasters are commonly considered the addressees of an international legal duty to rescue at sea. This article describes the evolution of international law in this field, from the first maritime conventions of the 1910's to the IMO Safety Committee's resolutions of the 2010's. It then argues that behind the duty to rescue there is a hidden right of the shipmaster. This right has a moral pedigree and is functional to the full compliance of the duty itself. It can be enforced in the national legal order against any State (or private entity) that tries to obstruct the shipmaster's activities of assistance or to penalize her or him for the assistance given. National judges enforce this right …
Itinerari culturali
2015
Distinguishing Trust from Risk: An Anatomy of the Investment Game
2009
The role of trust in promoting economic activity and societal development has received considerable academic attention by social scientists. A popular way to measure trust at the individual level is the so-called “investment game” (Berg, Dickhaut, and McCabe, 1995). It has been widely noted, however, that risk attitudes can also affect decisions in this game, and thus in principle confound inferences about trust. We provide novel evidence shedding light on the role of risk attitudes for trusting decisions. To the best of our knowledge our data are the first rigorous evidence that (i) aggregate investment distributions differ significantly between trust and risk environments, and (ii) risk a…

La capilla de la Virgen de Campanar en Valencia: tradición popular erigida en erudita retórica visual
2018
This chapel forms part of the parochial church of Campanar, which belongs to the municipality of Valencia. The Virgen de Campanar (Virgin of Campanar) is an image executed in alabaster, discovered on the subfloor of the church of this place on February 19th, 1596, by some construction workers who were undertaking some remodeling at that time. From that moment forward it began to be worshipped by the masses as a miraculous image. Among its alleged properties we find the mysterious fact that powder from its plaster had miraculous effects: it was taken dissolved in water to cure the sick or to assure a healthy birth for pregnant women, and it even calmed storms at sea if it was thrown into the…

Jurisprudencia valorativa y jurisprudencia creativa
2023
After analyzing pros and cons of the legal syllogism, the chapter contextualizes the opposition between evaluative and creative jurisprudence in the current evolution of law, finding in the respect of the rule of law the key for the correct reading of the judicial decision-making. The latter is a contribution to the building of the legal system in which it is possible a form of participation of the parties
Cross-Talk Correction Method for Knee Kinematics in Gait Analysis Using Principal Component Analysis (PCA): A New Proposal
2014
International audience; Background: In 3D gait analysis, the knee joint is usually described by the Eulerian way. It consists in breaking down the motion between the articulating bones of the knee into three rotations around three axes: flexion/extension, abduction/adduction and internal/external rotation. However, the definition of these axes is prone to error, such as the "cross-talk'' effect, due to difficult positioning of anatomical landmarks. This paper proposes a correction method, principal component analysis (PCA), based on an objective kinematic criterion for standardization, in order to improve knee joint kinematic analysis. Methods: The method was applied to the 3D gait data of …
On the Role of Interpretation Schemes in Organizational IS Implementation
2006
The objective of this study is to clarify how interpretation schemes held by people involved in organizational IS change affect implementation efforts and the outcomes of user participation. It is found that interpretation schemes are dealt with in many ways in IS literature and the approaches are diverse and scattered. Based on the findings, It is asserted that during IS change, not only "tangible" changes are made, but first and foremost changes are needed to occur in the interpretation schemes that give meaning to the phenomena changed. It is also suggested that the outcomes of user participation are mediated by the interpretation schemes of the participants and, consequently, the effect…
