Notes on the Spanish Supreme Court Ruling That Considers Riders to Be Employees

Spain is one of the countries with highest levels of judicialisation of the dispute over the classification of platform working. Dozens of rulings have been issued in recent years. Most have pointed out the labour relation of platform workers in the transport sector, although some have argued that they were truly self-employed. This contradiction in judicial doctrine has allowed / forced the Spanish Supreme Court to rule on the matter. This ruling of 25 September 2020 (rec. 4746/2019) was issued by the plenary session of the Supreme Court on social matters, the decision being adopted unanimously by all the magistrates. The people have right to defending their interests in judicial proceedings. The legal means available to the parties in the lawsuit include the exceptions of illegality. These are means of defence and not exceptions to the procedure law or substantive law; as a result has a special legal regime. In administrative judicial procedure the exception of illegality may be invoked at any time, to any court. The court of justice competent to decide on exception is that which is invested with initial substantive dispute. It eliminates one of the causes of delays in judicial process.

This chapter presents a participatory model for promoting organisational learning and innovation with potential application in criminal justice related organisations. We share the sensemaking process engaged in by the COLAB consortium tasked with comparing and contrasting a range of participatory interventions and developing a potentially hybrid model that combined the strengths of each. We describe this model on 11 key dimensions, that in themselves offer a useful tool through which different participatory methods might be compared. Vertical representation of C∞-words

We present a new framework for dealing with C ∞ -words, based on their left and right frontiers. This allows us to give a compact representation of them, and to describe the set of C ∞ -words through an infinite directed acyclic graph G. This graph is defined by a map acting on the frontiers of C ∞ -words. We show that this map can be defined recursively and with no explicit reference to C ∞ -words. We then show that some important conjectures on C ∞ -words follow from analogous statements on the structure of the graph G.

It is not more than 5 years since legal clinics were founded in Italian Universities: a very recent history indeed and similar to that of other Western European countries. I will try to explain this through some data collected by an inquiry that I ran in order to have a more detailed map of this phenomena and to conjecture its future evolution. In the following paragraphs I will present the data inquiry and I will try to explain the process of establishing the Italian movement for legal education, its options and challenges. This paper offers a diachronic reconstruction of MacCormick's theory of law and legal argumentation: In particular, two related points will be highlighted in which the difference between the perspective upheld in Legal Reasoning and Legal Theory and the later writings is particularly marked. The first point concerns MacCormick's gradual break with legal positivism, and more specifically the thesis that the implicit pretension to justice of law proves legal positivism false in all its different versions.
