Od systemu celkowego do systemu dozoru elektronicznego. Zmiany w sposobie wykonywania kary pozbawienia wolności

2020

The evolution of the methods for execution of the custodial penalty demonstrates changes in the treatment of convicts. In the historically oldest systems, the aspect of subjectivity of convicts was completely omitted in favour of their complete isolation (objectification), which resulted in the lack of corrective effects. It was only later that the system of progression in its various forms was adopted, which allowed strengthening of the convicts’ position by appreciation of their work and education as well as gradual mitigation of the effects of prison isolation. Finally, the concept of executing a penalty outside the prison in the electronic surveillance system was adopted, which departed…

Kilka uwag o historii klasztoru w Opolu-Czarnowąsach

2020

This article consists of two chapters. The first one presents an outline of the history of the convent in Czarnowąsy and objects of historical value situated therein. In the second chapter, the author mentions several issues related to the convent (which used to belong to the Norbertines) that still offer open fields for studies: the historical value of the short story “Uparte mniszki” by Zofia Kossak; Paweł Szotarewicz’s dedication to Baltazar Gerbert, the architect of the so-called House of Nuns; and the hypothetical visit of the then 29-year-old King Frederick the Great to this “House of God”.

Internet of Things and biometric data versus employee privacy in the Polish case

2020

The Internet of Things is a modern technology that affects every area of human life, includ- ing employment relationships. IoT enables the processing of specific personal data categories, including biometric data, and entails the risk of employers interfering with employee privacy. The relationship between an employee and an employer includes two subjects of legal protection, the meeting of which may lead to internal contradiction. There is the employee’s dignity and privacy, on the one hand, and protection of reasonable interests of …

Prace nad kodyfikacją prawa karnego procesowego w Polsce w latach 1919–1928

2020

In his contribution, the author presents the work on the codification (initially on the Act) of procedural criminal law in Poland in the years 1919–1928. Those works were initially led by the Criminal Department of the Codification Committee, and then by the Criminal Proceedings Section of the Codification Commission. The first period of the work on the criminal procedure law was characterized by some disputes between the members of the Department, i.e. supporters of the classical school (E. Krzymuski) vs. the sociological school (J. Makarewicz), the discussion aiming at defining the relationship of procedural criminal law and substantive criminal law. The work on the draft law was carried …
