2011

Abstract: Along with Spain and United Kingdom, Italy has suffered a terrible period of political violence between 1970 and 1982 with hundreds of killings. In this paper I analyse the origins of Luigi FERRAJOLI’s theory of legal guarantee and his criticisms to Italian legislation against terrorism of that time. Therefore, I shed light on three different understanding of such a theory and I offer a review of that legislation that he labelled as «the subsystem of exception ».Moreover I will apply this conception of «special» criminal law to two famous trials against militants of a group of the extreme left. According to FERRAJOLI, these trials have been an instance of the paradigm of political…

What Gender-Neutral Legislation Owes to Grammar: The Concept of ‘Gender’ in Legal English and the Italian Guidelines for Use of Gender-Sensitive Lang…

2022

Gender-neutral language, also called non-sexist, genderinclusive, or non-gender-specific language, refers to language that includes words or expressions that cannot be taken to refer to one gender only. As a matter of fact, languages vary widely in terms of gender systems showing differences in the number of classes, underlying assignment rules and how and where gender is marked. In everyday speech, the word gender is usually associated with the biological and social differences between men and women (as in the case of Italian), and the view that grammatical gender mirrors natural gender is still evident in the terms masculine, feminine, and neuter that are used to label individual gender d…

Legislación educativa española y educación en valores

2013

The objective of this paper is to analyze the changes in the …

2013

From the 1950s Luigi Sturzo captured the dysfunctions of the democratic system instituted in Italy. He courageously denounced the evils that afflicted the newborn democracy. The strange relationship between government and opposition, the growing importance of the parties, the proliferation of legislation, the reversal of functions between parliament and government, the reform of the Senate, are just some of the problems identified by Sturzo. His criticism, however, was not pointless but proactive in the meaning that he diagnosed in weaknesses and indicated the means for a better and more efficient working of institutions in a democratic country without making it necessary to undermine the c…

Is the Reform of the Spanish Public Pension System of 2011 Justified from an Actuarial Point of View?

2012

The aim of this paper is basically to answer three questions about the Spanish public retirement pension system. Is the 2011 reform of the system, which will gradually come into force starting on 1-01-2013, justified from an actuarial point of view? What measures would have been adopted in the Spanish system if all the accounting principles applied in the notional account pension system in Sweden were enforced? What measures would be adopted if current legislation on defined benefit private pension plans were applied to the system? To this end we formulate a Swedish-type actuarial balance for the Spanish public retirement pension system as at 31-12-2010 and project a solvency indicator for …
