This article seeks to discuss some of the conclusions V. Llombart’s study arrives at about the figure and the meaning of the count of Campomanes in the context of absolutism during the second half of the XVIIIth century. More specifically, it calls in question the idea of an action led by a reforming possibilism, half way between the non-enlightenment and the revolution, which would permit, besides, to establish a doubtful line of continuity among some of the reforms of the second half of the century and the plans of Cádiz. It proposes, on the contrary, to reintroduce an interpretative logic not so attached to the schemes of “market” and “state”.

The matter could reveal even more difficult because some characteristics as the restrictions and the personality are common both to the administrative sanctions and to the penal crimes. The conseguences of a similar interpretative chioice are not only descriptive; indeed this has remarkable effects from the perspective of the judicial protection, in fact this may involve the extenction of the penal system protection in an administrative authority procedure.
