On the 3rd of May, the Rome Tribunal accepted the complaint lodged by the Ministry of Interior against the interim measure with which, last January, the same Court declared the illegitimacy of the procedure of migrants and asylum seekers informal readmission in Slovenia, because of the violation inter alia of the principle of non-refoulement. Despite the negative outcome for the asylum seekers, the order of the complaint did not refute the reasoning of the judge of the first instance who, for the first time, recognized the entry protection by issuing an urgent precautionary measure. The first formal distinction between human smuggling and trafficking in international law was made with the signing in December 2000 of the Palermo Protocols. These definitions have influenced and shaped most of the academic research, discourse, methodology and language on human smuggling and trafficking. This article focuses on skilled migration flows from Southern Europe into Mexico. From semi-structured interviews with Spanish and Italian immigrants living in four Mexican cities of Mexico, it addresses both reasons for immigration and labour incorporation in Mexican labour markets. Specifically, it explores: i) the role of the economic crisis and the lack of good employment in the countries of origin as a key factor when deciding an international migration; ii) the employment opportunities offered in Mexican labour markets for the highly-skilled immigrants, and iii) the role played by the Mexican state and its current immigration law when channelling this group into the labour market

The phenomenon of migration of intellectuals, also known as "brain drain", we mean that constant transfer of highly qualified persons, especially in generally into less developed countries, to those states that have a developed economy. Most often, aspects of the social environment of home country, are the triggering factor in the migration decision intellectuals. Reducing the negative impact of brain drain can be achieved through the transfer of "know-how" through collaboration between intellectuals in the Diaspora with those of the country of origin in some projects.

Purpose In this paper, the following research question is addressed: Why do business organisations recruit employees with a foreign background? This was examined in terms of the values that guide organisations and their management. The paper aims to discuss this issue. Design/methodology/approach The study focused on two businesses in Finland that are pioneers in the recruitment of immigrants. A case study approach was adopted.
