Civil religion: uses and misuses of a concept. The analysis of the concept of “civil religion” shows an ambiguity caused by the mix between religion and morality, and religion and politics. The idea behind is the sacralization of politics in order to assure its autonomy from historic religions. Civil religion supporters individuate in this cultural position two positive results: the opening of politics to transcendence and the ethical legitimation of communitarian linkages. The article examines these two aspects, in the light of constitutionalism, human rights and current pluralism. The conclusion is that the concept must be considered misleading.
Reasons, Rules, Exceptions. Towards a Psychological Account

In this paper we defend a psychological account of rule-based reasoning, specifically of the relationship between rules and exceptions. The topic of our inquiry are the relations between rules, the reasons underlying them, and exceptions. In analysing these relations, first, we outline an apparent paradox, the “paradox of rules”, and a related problem, the “problem of reconsideration”. Then, we propose a solution to, or better dissolution of, the paradox, grounded in an account of the psychological processes underlying rule-application and reconsideration. The paper deals with the “conventionalist turn” in legal positivism in relation to the matter of the duty to obey the law and legal normativity. In this respect, conventionalist legal positivism is worth considering (a) because it offers an explanation of legal normativity partly different vis-a-vis previous ones and (b) because it tries to preserve the autonomy of legal obligation from moral obligation and coercion, respectively. An immense task: Hart sull'obbligo di obbedire al diritto

The topic of legal normativity absorbed Hart until the last years of his life. This paper offers a diachronic analysis of Hart’s perspective on the obligation to obey the law. The aim is to show that, at least as regards the justification of the obligation to obey the law, Hart’s former attempt to maintain the autonomy of law from morality and coercion is not convincing and that the “conventionalist turn” sketched in the Postscript leads to a dead end. Therefore, to give up the autonomy of legal obligation from moral obligation seems the only way forward, being aware that this move does not imply the abjuration of legal positivism.
