Il saggio prende in esame la teoria del diritto costituzionalista di Luigi Ferrajoli. Nel criticare le teorie del diritto anglosassoni, che vanno oggi per la maggiore, l'autore sottolinea l'utilità di una teoria pragmatica del diritto che sia adeguata all'esperienza giuridica del mondo latino. Una teoria che stabilisca una certa connessione tra diritto e morale e riconosca il ruolo che nel diritto hanno i principi, da sottoporre a bilanciamento, oltre alle regole. Il ruolo dei principi rende manifesto che nel diritto sono importanti non soltanto i riferimenti all'autorità, ma anche ai valori morali.

This paper discusses the criticism of naturalism based on the irreducibility of first-person-perspective facts. This critique considers naturalism insufficient since it proposes the view of reality as a centerless dimension. However, simply reintegrating subjective facts into a naturalistic view of reality we eventually produce a split situation in which conscious and self-conscious forms of life require a special consideration, thus appearing as separated from the whole of reality. In this paper, we raise a few questions for Bartosz Brozek, Monica Bucciarelli and Philip Johnson-Laird. The questions we ask to Bucciarelli and Johnson-Laird concern the nature of the “sense of correctness” which is at the heart of our normative judgments and reasoning, and the status of the laws of logic relating to mental models. Our questions to Brozek concern the distinction he traces between rudimentary and abstract rules, the role of language in normative behaviour, and the role of mental simulation in the understanding of abstract rules.

From the 16th to the 18th century, a deeply rooted tradition of open and celebrative inebriation existed in the kingdom of France. Society permitted collective, festive and social drinking. But many opposed drunkenness. In France at that time, absolute monarchy from divine right was developing, and the fundamental opposition came from religious and civic powers. Drunkenness was seen either as a sin or as a vice of variable severity that drove others to commit it as well. Mbembe’s most important works On the Postcolony (2000), Critique de la Raison Nègre (2013), and Politiques de l’intimité (2016) are read as a coherent system aimed at unfolding the philosophical meaning of different forms of racial segregation. Race is outlined as a principle of separation whose broader meaning lies in forcing the multi-layered human experience into rigid categories, thereby achieving the objectifying of humans. Starting from the analysis of the concept of modernity, this contribution focuses on Habermas' critique of Nietzsche. In particular on the idea that Nietzsche is a break point with modernity and the basis of the post-modern. On the line of defense of modernity and its universalistic normative contents, Habermas re-proposes the transcendental in an anti-relativistic sense. The explosive power of "philosophy with the hammer" and the "total critique of reason" undermine the emancipatory demands of modernity with conservative effects. La ragione naturale viene contrapposta alla ragione soprannaturale contrario della trionfale sintesi hegeliana. Questa si costituisce come arresa vincente: dopo essersi dichiarati sconfitti, manifestata la propria impotenza di soluzione dell’ossimoro e divenuti ormai completamente coscienti del limite, si viene trasportati nell’immenso universo che contiene tutti gli opposti.
