UNCLOS and territorialization of the seas: the case of Indian and Pacific Oceans

The 200-nautical-mile Exclusive Economic Zone created by the 1982 UNCLOS regime generates conflict in areas where the distance between opposite national coasts is less than 400 nautical miles and in marginal seas surrounded by many states and with islands. This is the case of the marginal seas in the Indian and Pacific Oceans. In particular, the EEZ regime has proved troublesome in the South China Sea, leading some authors to ask whether it has actually strengthened or undermined peace and cooperation. By Resolutions No. 1483 and 1511 (2003), the Security Council authorized the occupying powers in Iraq to intervene in the political and economic affairs of the occupied territory beyond the limits provided for by international law of war. At the same time, this authorization restricts the right of the Iraqui peole to self- determination, considered in its external aspect. Thus, the problem arises whether it is within the Security Council's powers to adopt resolutions which restrict the enjoyment of rights protected by rules of jus cogens. Can Public-Private Partnerships be applied to global affairs and governance? This paper reviews the existing relations between public and private global actors. I argue that current international politics is largely an outcome of these relations. Although for the foreseeable future the role of traditional nation-states on the global scene should not be dismissed, they come under the constant pressure of different private actors, particularly of MNCs and NGOs. Interpreting the Sustainable Development Goals through the Perspectives of Utopia and Governance

The article analyses the Sustainable Development Goals (SDGs) from the perspective of their self-understanding of political sense expressed in key SDG documents, including both UN documents and reports produced by individual countries. Utopia and governance are presented as ideal-typical approaches and analytical tools for qualitative content analysis. This approach is argued to be particularly illuminating in the case of politics of international development, as international development is simultaneously highly utopian and deeply embedded in rationalities of governance. This contribution examines the problem of what is the legal basis for armed interventions carried out on foreign territory in response to terrorist attacks. It proposes a solution other than the use of the right of self-defence provided for in Article 51 of the UN Charter, based on the idea that a State cannot claim full respect for its sovereignty as a right if it does not fulfil the functions that come with sovereignty as a duty.
