Rhetorical deliberation. A sustainable normativism from a Gorgianic-Aristotelian perspective

Starting from the discursive turn that has characterized democracy since the 80s of the last century, our article tries to outline a form of sustainable normativism. To do this, we use a theoretical framework derived from ancient Greek rhetoric and in particular from the reflection of Gorgias and Aristotle. In our perspective, on the one hand, the Gorgianic view is a useful reminder of the role that the pursuit of power and the possibility of conflict unavoidably play in the form of argumentation specific to the public sphere, that is, deliberation. A dieci anni dall’uscita di The Concept of Law, Alfonso Catania pubblica, sulla prestigiosa Rivista internazionale di filosofia del diritto, un saggio critico dal titolo: L’accettazione nel pensiero di Herbert L. A. Hart. Si tratta di un saggio meritatamente celebre, di cui è difficile esagerare l’impatto oggettivo e anche soggettivo. In questo saggioproporrò una ricostruzione delle tesi salienti del saggio di Catania del 1971 e, a partire da questa ricostruzione, metterò finalmente in bella forma alcune delle mie “osservazioni a margine” che si sono sedimentate nel corso degli anni sulla mia fotocopia, ormai lisa, de L’accettazione del diritto nel pensiero di Herbert L. Starting from Sperber and Mercier’s theory (2011) on the relationship between reasoning and arguing, we will try to rethink the link between rhetoric and argumentation. Using Aristotelian rhetoric as a theoretical framework, we will focus on two related features: 1) the nature and the role of argumentation inferences in classical models of rhetoric; 2) the role of normativity in assessing a naturalistic description of what we make when we argue.

Article deals with the relationship between Carl Schmitt’’s political theory and political theology, which inherently works with the violence assumption, and the so called jewish question. Author shows the way the enemy of the political is gradually constructed on the basis of textual and doctrinal analysis. The core of Schmitt’s enemy construction depends on the refusal of the philosophical tradition, which assume that all man are equal as far as they are participating in one common nature or are in actual or potential possesion of reason.
