Uno sguardo alla tutela processuale delle obligationes re contractae in rapporto alla sistematica edittale consente di individuare correttamente i rapporti fra questo genere di obbligazioni e il titolo De rebus creditis (LENEL, EP, Tit. XVII). In particolare, una volta precisato cosa debba intendersi per ‘certum’ nel lessico dei giuristi romani, si potrà stabilire se e in quale misura la nozione del credere edittale riferita in D. 12.1.1.1 (Ulp. 26 ad ed.) coincida davvero con quella delle obligationes che nascono dalla datio di un bene.
