Resumen: Los críticos del positivismo legalista en la transición del siglo XIX al XX -Gény, Ehrlich, Kantorowiz- enfrentaron una concepción plural del derecho a la ley como única fuente formal del derecho y al Estado como una única fuente material del derecho. La semejanza de estos críticos y el derecho indígena en general -y en particular el derecho indígena zapatista- es asombrosa tanto en lo que respecta a la defensa de una pluralidad de normas como a la génesis y formación histórica de las mismas.

The essay examines the natural law economics of the eighteenth century and the evolutionist economics of the nineteenth century by focusing on their methods for achieving a common, nebulously articulated goal: individual fulfillment and the happiness and welfare of mankind in a free, harmoniously ordered society. The main tenets of action language are summarized in an attempt to discern the direction in which psychoanalysis might go if action language becomes the "new metapsychology." The principal roots of action language are traced to the different linguistic/language and personality-and-culture models of anthropology and to the neobehaviorist currents of academic psychology. The authors' findings support the hypothesis that action language is a form os psychoanalytic behaviorism having idealism, logical positivism, and radical empiricism as its philosophical underpinnings. This is a commentary on the ESM 2021 Special Issue on Innovations in Measuring and Fostering Mathematical Modelling Competencies. We have grouped the ten studies into three themes: competencies, fostering, and measuring. The first theme and the papers therein provide a platform to discuss the cognitivist backgrounds to the different conceptualizations of mathematical modelling competencies, based on the modelling cycle. We suggest theoretical widening through a competence continuum and enriching of the modelling cycle with overarching, analytic dimensions for creativity, tool use, metacognition, and so forth. This paper discusses the relevance of IS research with respect to the rhetoric associated with three IS research paradigms in use - positivism, constructivism/interpretivism and critical research. The discussion is framed in terms of the following dimensions: ontological, epistemological and methodological assumptions, relationship between theory and practice, and the role of the researcher in the research process. RESUMEN. La teoría de los derechos fundamentales de Robert Alexy se fundamenta en un concepto material de norma jurídica que es de carácter doble. Por un lado, se define por los rasgos propios de los principios, en consonancia con la idea de argumentación correcta. Pero, por otro lado, sigue teniendo peso la validez jurídica de las normas que contienen derechos fundamentales, consideradas como reglas constitucionales. Tal y como se argumenta en el trabajo, esta ambigüedad de la teoría de la norma de Alexy permite distintos acercamientos, positivistas y no positivistas, que es signo de su riqueza teórica. ABSTRACT.
