The paper deals with the argument against Dworkin’s interpretative turn put forward by Andrei Marmor. Mamor's claim is the following: a constructive theory of the interpretation and the identification of law is falsified by the conception of legitimate authority proposed by Joseph Raz. That argument consists in two passages. The first passage is concerned to show that Dworkin necessarily has to refute, out of a need for consistency within his theory of law, the communication-intention model of interpretation. ‘What’s the Plan?’: On Interpretation and Meta-interpretation in Scott Shapiro’s Legality

This chapter seeks to explain and evaluate Shapiro’s theory of legal interpretation, as it is outlined in his recent book ‘Legality’. More specifically, in the following I will try to provide (a) a reconstruction of Shapiro’s theory of legal interpretation, as it is developed in ‘Legality’; (b) an assessment of this theory of interpretation on its own terms (i.e. its internal coherence, its overall persuasiveness); and (c) an evaluation of the compatibility of this theory of legal interpretation with the general project of ‘law as plan’.

In his latest book Massimo La Torre makes a number of criticisms to legal positivism. Most of them are convincing. In this essay I try to reply to the few I disagree with. In particular, I deal with La Torre’s objections against Hart’s theories on legal interpretation and the internal point of view and against Raz’s theory of legitimate authority. In the last paragraph I outline some ideological reasons for not considering legal positivism entirely dead.

Organe des « Jeunes-Turcs », ces officiers réformateurs brésiliens partis en Allemagne entre 1906 et 1912 pour finaliser leur formation, la revue militaire A Defeza Nacional demeure aujourd’hui l’un des principaux lieux d’exposition de la doctrine des forces armées. Dirigée par Bertholdo Klinger, elle popularisa la thèse du pouvoir conservateur des militaires, moins sous l’angle constitutionnel que sous l’aspect social, du fait des interférences du « pouvoir spirituel » du positivisme comtien.
