FINLAND: The Importance of the Private Sport Sector Has Increased in the 2000s

The voluntary sector and the public sector continue to be the main actors in the Finnish sport system; however, in the last decades their importance has declined. Along with the economic downturn, the number of services offered in the public sector has been reduced, and the nature of volunteering has also changed. Voluntary work has received market-based and consumer-like features. Services previously produced by volunteers are currently settled by payments. Owing to changes in the voluntary sector and in the public sector, the importance of the private sector has increased in the 2000s.

L'articolo evidenza il concetto di controllo tra un'amministrazione pubblica ed un organismo avente natura privatistica dalla stessa controllato. L'ordinamento europeo e quello nazionale ammettono la possibilità che un'amministrazione proceda all'affidamento diretto di un contratto pubblico, cioè senza gara pubblica, a società dotate di personalità giuridica controllate dalla stessa a condizione che la prima eserciti sulla seconda un controllo analogo a quello esercitato sui propri servizi e questa realizzi la parte più importante della propria attività con l'ente o con gli enti che la controllano.

La corruzione privata e la riforma dell'art. 2635 c.c.

L'articolo esplora il trattamento penale dei fatti di corruzione privata, anche alla luce della recente legge n. 190/2012. Due le tesi principali sostenute: 1) contrariamente a quel che si crede, nel nostro ordinamento esiste già (ed esisteva anche prima del 2012) una incriminazione - sia pur non diretta - dei fatti di corruzione privata; 2) la riforma del 2012 cambia l'offensita' tipica dei reati di cui all'art. 2635 c.c., affiancando alla tutela del patrimonio, una tutela della concorrenza quale interesse dei consumatori. The paper explores the Italian discipline on private bribery, which has recently undergone significant reform through law no. 190/2012.

Patterns of international capital flows and their implications for developing countries

According to standard economic theory, capital should flow from rich to poor countries. However, a reverse pattern has prevailed in the world economy. This is the so-called Lucas paradox. In addition, it has been shown that, counterintuitively, there is a negative correlation between capital inflow and productivity growth across developing countries. This is the so-called allocation puzzle.
