Green taxes, quotas and equality : preserving social justice whilst averting climate change

The need for green fiscal reform is urgent in the face of climate change. Some oppose it, however, arguing that such reforms disproportionately burden poorer individuals whose emissions are far smaller than those of wealthier individuals. Defusing these criticisms, this paper argues that this is not an inevitable feature of green fiscal reform. We should adopt a more scientific attitude not only towards climate change but towards testing fiscal proposals to mitigate it, and avoid dividing, with rushed assumptions, responsible voters who care about both equality and climate change.

Starting from the statistical data on female participation in the bodies of the Italian publicly controlled companies – unfortunately worse that those relating in general to listed companies –, the article aims to identify some weaknesses of the current legislation of gender quotas in unlisted publicly controlled companies, recently amended by Article 6 of Law no. 162/2021. In this perspective, some proposals de iure condendo are formulated, also in the light of the most recent Italian legislative initiatives.

La crisi economica è un fattore sempre presente nelle argomentazioni dei giudici. Aumenta il tasso di litigiosità e il potere giudiziario deve valutare la legittimità del-le scelte della pubblica amministrazione e la reazione giudiziaria dei lavoratori pubblici nel tentativo di recuperare, in tutto o in parte, le quote di retribuzione perdute (o non adeguate nel corso del tempo).

The aim of this paper is to analyse the evolution of gender balance in the Italian Constitutional system with respect to electoral representation. Even if Art. 51th of the Italian Constitution provides that “Any citizen of either sex is eligible for public offices and elected positions on equal terms, according to the conditions established by law. The aim of this paper is to analyse the evolution of gender balance in the Italian Constitutional system with respect to electoral representation (Art. 51th of the Italian Constitution). Effective achieving of electoral representation has been heavily difficult for women in Italy. In 2010 the Constitutional Judge recognized the necessity of gender balance measures. However, the instruments provided by laws had not any real success and women are not effectively represented in political Assemblies.
Yearly quotas and country-reserved shares in Italian immigration policy

Regular immigration to Italy is based on a quota system setting annual ceilings to legal entries. Reserved shares are granted to single countries or categories of countries. Reserved shares have been increased; they are used as an incentive to obtain the cooperation of countries of origin in stemming irregular migration flows. The total quota of regular immigration has gradually increased too. Still, it does not fully respond to the growing demand of foreign workers on the labour market, and quotas seem to be used as crypto-regularisations rather than as an instrument for regulating legal entries.
