2022

Corte cost. nn. 69 e 70 d…

Succession of states in respect of state responsibility: towards yet another Vienna Convention

2020

The end of the twentieth century was characterised by a series of state dissolution cases, such as the breakup of Czechoslovakia, the Socialist Federalist Republic of Yugoslavia, and the Soviet Union. In that context, the rules on state succession regained relevance, with the issue of state succession in respect of international responsibility becoming central. The topic first attracted the attention of the academic community and subsequently was chosen by the International Law Commission for study and codification. The present article examines the historical evolution of the rules on the succession of states, providing a review of case law where the Court referred to the concept of state s…

2023

In this chapter the traditional legal issues concerning the legal regime which applies to international law violations are described, according to an original perspective. First of all, some specific problems (such as the place of fault and damage; the moment in which a violation can be considered as being committed, and the conditions governing such a commission; the role to be recognized to countermeasure in the general framework of the legal consequences of internationally wrongful acts, etc.) are solved, at variance with the mainstream opinion. Second: the elements of an internationally wrongful act as well as its legal effects are both examined with regard to the general regime and som…

The United Citizens Organization: Public-private partnerships in global governance

2020

Abstract Can Public-Private Partnerships be applied to global affairs and governance? This paper reviews the existing relations between public and private global actors. I argue that current international politics is largely an outcome of these relations. Although for the foreseeable future the role of traditional nation-states on the global scene should not be dismissed, they come under the constant pressure of different private actors, particularly of MNCs and NGOs. If this is the case, the question of global responsibility must be raised. It has been the traditional role of governments to stand for such societal values as security and prosperity, and be responsible for their citizens. Wi…

Evaluating Attribution of Responsibility and Minimization by Male Batterers: Implications for Batterer Programs

2008

Men arrested and condemned for intimate partner violence assaults tend to use external attributions to justify their behavior and tend to minimize the severity of their violent acts. Responsibility assumption is one of the main goals in many batterer programs because it could facilitate behavioral changes and reduce the dropout rate. In the current study, first we aim to create two scales to assess attribution of responsibility and minimization of incidents of partner violence, and second, to classify batterers based on their levels of minimization and their attributions of responsibility. Participants were 119 male batterers attending to the first assessment session of a court mandated bat…

Barriers in organizing the Romanian firms in responsibility centers

2017

In the current turbulent business environment, the big and medium enterprises must organize their activity in order to face new challenges. One of the organizational forms that can stimulate the performances of the firms is the one in responsibility centers. This paper addresses the issue of the responsibility centers starting from the possibility of using benchmarking before and after the implementation of this organizational form. After highlighting the advantages of the responsibility centers, we presented a study made in Romanian big and medium organizations, regarding the barriers in the design and implementation of this organizational form. Top Management Team Diversity and Ambidexterity: The Contingent Role of Shared Responsibility and CEO Cognitive Trust

2017

Earlier research has suggested that diversity is a double-edged sword when achieving organizational ambidexterity. While it may contribute to the development of new combinations of exploration and exploitation, it may also lead to disagreements and potential conflict within top management teams (TMTs). To improve our understanding of the effectiveness of diversity in ambidextrous organizations, we develop a synergistic perspective on TMT diversity and examine how two types of diversity – functional and age diversity – affect the achievement of organizational ambidexterity. We also identify shared responsibility and CEO cognitive trust as important contingencies that may complement the effec…
