Weaving the threads of international criminal justice: The double dialogicity of law and politics in the ICC al-Mahdi case

International audience; In this paper, we examine the international criminal trial of Ahmad al-Faqi al-Mahdi, a Malian Islamist who appeared before the International Criminal Court (ICC) in The Hague, charged with the destruction of Islamic shrines during the 2012 jihadist occupation of Timbuktu. Much Cry and Little Wool?: Determining the Exact Role of the Inter-national Criminal Court in Transitional Justice Efforts

The International Criminal Court (“ICC”) is a milestone in the fight against impunity. However, the expectations for what the ICC can achieve have often been distorted. Thus, the main research question of this Article is: what exactly is the role of the ICC within transitional justice efforts? My answer consists of three parts. First, there is a need to delimit the ICC’s mandate, namely, what it means to be an international criminal tribunal as opposed to other international bodies, and how the ICC is embedded in a system which includes the States Parties to the ICC Statute. AbstractAlthough victims at the International Criminal Court (ICC) are not parties, they can apply to become “victim participants” and may be authorized by an ICC Chamber to directly and orally express their views and concerns in court. Most ICC Trial Chambers, however, have preferred allowing legal representatives of these victim participants to call victims as witnesses to give testimonial evidence about the harm they suffered. This article elucidates the role of metapragmatic devices like footing and stance-taking in trial hearings before the International Criminal Court (ICC) in The Hague. It focuses on the case of Ahmad al Faqi al Mahdi, a Malian Islamist found guilty of the 2012 destruction of cultural heritage in Timbuktu. The Rohingya are one of the most persecuted minorities in the world. Military campaigns conducted by Myanmar against the Rohingya have led to numerous deaths, widespread cases of sexual violence, the destruction of hundreds of villages, and the deportation of more than 700,000 people to Bangladesh.
