I fratelli De Minicis e la riscoperta del teatro di Falerone: spigolature architettoniche

L'articolo ripercorre le vicende della riscoperta del teatro romano di Falerone grazie agli scavi ottocenteschi dei fratelli De Minicis. Le informazioni inerenti il monumento desunte dai documenti di scavo e dalla relazione pubblicata da Gaetano De Minicis nel 1839 vengono messe in relazione con i resti architettonici oggi visibili. Una prima sezione è dedicata alla storia degli studi, una seconda parte all'analisi della struttura edilizia e delle membrature architettoniche, la terza parte all'analisi dell'impianto e dell'apparato architettonico, con delle considerazioni finali riguardanti il monumento, la sua datazione e il suo inserimento nell'impianto urbano.

The author examines the formula “ut inter bonos bene agier oportet et sine fraudatione” of the actio fiduciae from the point of view of its internal meaning. In particular, on the grounds of the sources of the third and second century B.C. the author argues (confirming the results of his recent research) that the qualification “vir bonus” underlying the words “inter bonos” indicates an ethical-behavioural perspective, not a social status; and proposes a reading’s hypothesis that attaches an autonomous role to the adverb “bene” (generally considered pleonastic respect to the terms “inter bonos”). In the light of unpublished material this paper reconstructs the history of the deciphering of Gaius’ palimpsest of the Capitular Library of Verona (BCapVr, Cod. XV) by Friedrich Bluhme. It deals for the first time with other copies of Bluhme’s transcriptions preserved at the Bonn University Library (ULB, S 675f; ULB, S 1440) and with their relationship to the ones at the Berlin State Library – Prussian Cultural Heritage (SBB-PK, Ms. lat. fol. 308, K. 2, Beil. 2, Fasz. 1).
