The article deals with the significance and role of the references to officium and beneficium in D. 13.6.17.3, concerning the commentary of Paulus to the iudicium contrarium commodati. In this text ‘officium’ expresses ethic dutifulness tout court; and the key-point of Paulus’ reasoning consists in underlining the coexistence of an ethical and a juridical dimension within the legal operation of commodare. In the light of the comparison between this and some other texts of the same Paulus (D. 17.1.1.4; 39.4.21; 43.1.2.1), it seems possible to suggest – as trace for a specific, future investigation – a peculiar attention of this jurist for ethical perspectives connected to legal institutions.

The present work has as its subject a noted constitution by Gordiano from 238 a.d. in which is discussed the theme of guarantee from eviction in terms of trade operations similar to emptio venditio. In terms of ad exemplum ex empto actionis given to the possessio venalis buyer this paper agrees with dominant theory which excludes an actio ex empto identification. Doubts are expressed however on the amenability of the agere p.v., and the conjecture put forward by E. Sciandrello that there was a revision of Celio Sabino's doctrine by the imperial chancellery is also here contested. The eleventh-century manuscript known as the Codex Farnesianus (now Naples, BNN, IV. A. 3) sole medieval witness of Sextus Pompeius Festus' work De verborum significatione, transmits Aelius Gallus' definition of the legal concept of possession (Fest. pp. 260-262 L.). The interpretation of this definition entirely depends on the reconstruction of the text. Two passages are problematical because of two blank spaces (fol. 11r int., lin. 3 and lin. 4), in connection with which the scribe characterizes the model of the manuscript as 'blind' (caecus).
