The paper deals with Paul. 5 quaest., a well-known text on subject of innominate contracts. The author comes to the conclusion that the current version of the text is largely interpolated. At least for § 5, the concession of the contractual action must be attributed to Justinian’s compilers. Great caution is required for § 4, although the use of the agere praescriptis verbis is to be excluded for relationships involving a factum, quod locari non possit: for such relationships, the use of the the actio de dolo or actio in factum must be assumed, as appropriate.

Honest mistake or perhaps not: The role of descriptive and injunctive norms on the magnitude of dishonesty

Trivial acts of dishonesty are very prevalent in everyday life and have severe economic and societal consequences. The present study aims to examine the role of descriptive and injunctive norms in minor and major dishonesty under ambiguity. We devised a novel experimental design in which rule violations can be the result of honest mistakes or various dishonest processes. In this ambiguous context, we observed a high prevalence of minor rule violations at baseline. National audience; Echinococcus multilocularis (Em) est un parasite responsable chez l'homme d'une maladie grave : l'échinococcose alvéolaire. La contamination humaine peut se produire par ingestion accidentelle d'œufs du parasite. Un programme européen d'épidémiosurveillance, EchinoRisk, est actuellement en cours. En France, ce programme, mené conjointement par l'ERZ (Entente interdépartementale de lutte contre la rage et autres zoonoses) et l'AFSSA (Agence française de sécurité sanitaire des aliments), a permis jusqu'à présent de collecter 5 820 échantillons localisés de fèces de renards. À ce jour, 2 305 échantillons ont été analysés parmi lesquels 62 ont révélé la présence du parasite. …
