Italian law only provides the general conditions for the institution of recall. It follows that significant discretionary powers are enjoyed by the surveillance judges (and in particular by the Surveillance Tribunal) who evaluate on a case-by-case basis whether the commission of another offence or the infringement of parole conditions demonstrate the offenders' negative attitude to reintegrate into society. Purpose When making judgements under uncertainty not only lay people but also professional judges often rely on heuristics like a numerical anchor (e.g., a numerical sentencing demand) to generate a numerical response. El evidence-based sentencing (EBS) es una denominación reciente para una pretensión que tiene hondas raíces en el Derecho penal: aplicar las penas más adecuadas al nivel de riesgo de reincidencia que presenta cada condenado para intentar reducir ese riesgo al mínimo posible. Esta versión moderna de la prevención especial se inserta en el enfoque más amplio de las «políticas públicas basadas en la evidencia».
