Przedmiotem niniejszego artykułu jest zagadnienie potęgi państwa. Przeprowadzona analiza skupia się na niematerialnych zasobach, oddziałujących w sposób znaczący na kształt potęgi państwa. W tym zakresie, przedmiotem rozważań stał się kapitał niematerialny, w ramach którego opisano istotność kapitału społecznego i kapitału ludzkiego. W efekcie wyrażono przekonanie, że kapitał niematerialny stanowi niezbędny budulec potęgi państwa.

The essay deals with a State aid case between companies belonging to the same corporate group. To clarify the concepts of ‘State resources’ and the misure imputable to the State, the essay suggests framing the concrete case within the framework of the so-called “in-house” company. This does not rule out the application of the private investor test in normal market conditions, which – if disregarded – can overcome the indistinction typical of “in-house” companies.

Niniejsze opracowanie odnosi się do zagadnień związanych z odpowiedzialnością odszkodowawczą Skarbu Państwa w stosunku do udziałowców dłużnika z tytułu błędnego orzeczenia o opcji upadłości likwidacyjnej zamiast o opcji restrukturyzacji. Postępowanie wszczyna się na wniosek uprawnionego. O otwarciu postępowania decyduje sąd. Se pretende llamar la atención sobre un par de frases que aparecen justo hacia la mitad de la controvertida doxografía de Aristóteles que se puede leer en las Vidas y doctrinas de los filósofos más ilustres de Diógenes Laercio V 31, y que desde luego no corresponden a ningún sistema doxográfico conocido.
