Abstract Purpose – This paper describes and analyzes the complexity of the regulation and the stipulation of public contracts in Italy, focusing speci cally on the failure of recent anti-pandemic investments. This is of particular interest during a state of emergency when it should be avoided to waste public funds and to speculate. Everything shows how the regulations of public procurement a fects the realization of big investments, the use of public funds and the possibility for anyone to pursue criminal purposes. L'articolo analizza un lavoro pubblicato dal prof. Criscuoli nel 1977 avente ad oggetto la possibilità di configurare un diritto soggettivo a morire di morte naturale. Si propone un'analisi delle legislazioni più avanzate di alcuni tra gli Stati facenti parte degli U.S.A. in confronto alle situazioni vigenti in Europa (in particolari in Svizzera, Belgio ed Olanda) ed alla casistica che emerge da un'esame delle fattispecie di cui si è occupata la CEDU
