The article discusses Francesco Viola’s new book, considered as a philosophy of positive law alternative to legal positivism. The starting point is the classification of his approach as characterized by the thesis of an interpretive connection of law and morals, evident in his itinerary through the three revivals of Natural law in the last century. In this article it is explained its origin and meaning, and it is shown that it is necessary to pursue its goals in the respect of the principles of the rule of law. Vulnerability, Human Rights and Climate Change

The article aims at establishing the specificity of the human rights approach to environmental issues such as the climate change, in order to test its advantages and limits. While responsibilities in the side of climate change is controversial, the approach from human rights and in particular from their vulnerability is easier to focus and define and it involves also the problem of inequalities produced by the degradation of environment. In addition, the human rights approach is dynamic (open to specification and to proceses of implementation) and it is compatible with an intergenerational perspective.

Le narrazioni sui diritti umani sono molteplici, non solo nella forma di storie diverse che convergono verso la pratica della loro tutela, ma anche come svariate interpretazioni e implementazioni. Nel libro si ripercorrono alcune di queste strade come storie esterne, dall'epoca medievale a quella contemporanea (proposte ideologiche parallele al mondo dei diritti), e come evoluzione interna di un fenomeno giuridico a partire dalla Dichiarazione universale del 1948.
