espanolEn este trabajo se realiza un analisis de los derechos del trabajador en excedencia voluntaria que se encuentra afectado en un expediente de regulacion de empleo, concretamente, del derecho a recibir la correspondiente indemnizacion por despido colectivo o no. La doctrina judicial y jurisprudencial ha negado que el trabajador excedente incurso en un expediente de regulacion de empleo tenga derecho a la misma. No obstante, ello va unido a la posicion que se tenga sobre la naturaleza juridica de la excedencia voluntaria, aspecto debatido entre la doctrina, tanto cientifica como judicial. En este sentido, una linea doctrinal ha considerado que la excedencia voluntaria tiene un caracter extintivo, mientras que otra una naturaleza suspensiva y otra estima que es un tertium genus EnglishIn this work, it is realized an analysis of the rights of the worker on voluntary leave who is affected in a labor force adjustment plan, specifically, the right to receive the corresponding compensation for collective dismissal or not.
