Il saggio esamina le principali disposizioni in materia di obbligazioni e di contratti introdotte dalla normativa emergenziale al fine di fronteggiare la pandemia di Covid-19 e tenta di ricondurle a sistema. Più nel particolare, molte delle norme esaminate, a dispetto della loro natura eccezionale, non fanno che applicare istituti del diritto generale delle obbligazioni e dei contratti, come l’impossibilità definitiva o temporanea, la risoluzione per impossibilità, la revisione volontaria del contratto etc. Di particolare interesse - anche per l’impatto applicativo - si rivelano le questioni relative alla gestione dei rapporti contrattuali di durata e ai riflessi delle misure restrittive delle attività economiche e non sul regime delle obbligazioni pecuniarie. Norme di taglio marcatamente eccezionale si registrano invece in materia restitutoria. The essay examines the main provisions on obligations and contracts introduced by the emergency legislation in order to deal with the Covid-19 pandemic and attempts to bring them back into the system. More specifically, many of the rules examined, despite their exceptional nature, only apply general provisions of the law of obligations and contracts, such as the permanent or temporary impossibility, the termination due to impossibility, the voluntary revision of the contract, etc. Of particular interest - also for the application impact - are the issues related to the management of long term contracts and the effects of the restrictive measures of economic activities and not on the regime of money obligations. Norms of markedly exceptional cuts are registered on restitution matters.
