The notion of habitual residence of the child plays a central role in the in Brussels II A Regulation system of jurisdiction in matters of parental responsibility. The lack of a definition in the Regulation leads us to define the habitual residence of the child as an autonomous concept of UE Law that the CJEU has clarified. In general terms, the CJEU has considered the child?s habitual residence as a matter of fact that must be specified in the specific case. However, at the same time, it has established interpretative criteria that are precisely the object of analysis of this article
