12, d.lgs. 19 agosto 2016, n. 175, T.U. in materia di società a partecipazione pubblica, e l’espressa previsione all’art.
Disabili e sport. Dalla terapia alla ricerca della felicità.
2020
The consideration that in postmodern society has assumed the sport practiced by so-called people disabled has clearly changed compared to what it was just seventy-five years ago, when for the first time the neurosurgeon Ludwig Guttman opened in 1944 in Stoke Mandeville one of the first European centers for the care and rehabilitation of subjects suffering from spinal injury. Currently we are witnessing a transition from the practice of physical activity for rehabilitation purposes to that of sports activity aimed at achieving performance even by people once viewed by law only as subjects "totally or partially unable".
A future European FDI screening system: solution or problem?
2019
The establishment of a mechanism at the European level for screening FDI, on the grounds of national security and public order, constitutes a major step in implementing the EU investment policy. To create an effective system, it must be based on clear common rules, provide certainty and ensure judicial redress.
L'Universitaire au pouvoir. Le discours juridique du professorat salazariste (1926-1974)
2023
In the shadow of the military, the Portugal of the Estado Novo (New State) was above all led by academics, especially those from the Faculty of Law in Coimbra. The generation of teachers born in 1880/1890, including all the deans (Beleza dos Santos, Cabral de Moncada, Fezas Vital, Figueiredo, etc.), gathered around Salazar, who held the chairs of public finance and political economy in Coimbra, and irrigated the state apparatus. It thus engendered an "Empire of the professor", a "dictatorship of the doctors" and even a cathedocracy. The present work studies their constitutional and legal thinking, explaining all their reforms (1933 Constitution, prison reform, codifications, especially in c…
Coordinates and Dynamics of the Relationships between Multinational Enterprises and Economic Development – A Theoretical Approach
2013
Abstract The paper aims to configure, based on the historical analyses of the theories regarding multinational enterprises and economic development (which, most of them, are unilateral, unidimensional and focused on just one theoretical background) a conceptual framework – subsumed to the idea of a matrix with variable architecture that integrates existing models – able to allow and favour the exhaustive and dynamic analysis of the relationships between multinational enterprises and economic development within the current and future spatial and temporal context – characterized by (enormous) complexity, turbulence and volatility.
European funding for reproduction research—A multinational perspective
2008
Funds from the European Union are not the only source available to the continent's reproductive research community. Each country independently sponsors the work of these scientists, but, as illustrated by snapshots in the following pages, there are huge differences in the commitment of the various European nations to tackle the challenges of reproductive biomedicine.
Ownership, Board Compensation and Company Performance in Sub-Saharan African Countries
2013
In countries with weak institutions, board governance becomes more important. This study uses a unique dataset from listed sub-Saharan African companies to examine the relationship between ownership composition and board compensation. It further analyses the association between board compensation and company performance. The findings indicate that board ownership and chief executive officer ownership are positively associated, whereas state ownership and concentrated ownership are negatively associated with board compensation. There is no evidence of a significant association between chairperson ownership or foreign ownership and board compensation. Finally, there is a negative but not sig…
Influence of board of directors on firm performance: Analysis of family and non-family firms
2015
This article analyses how board structure can affect both financial and social performance, comparing family and non-family firms. Our theoretical framework is based on the integration of the agency theory, traditionally used in the analysis of the impact of the board on the firm's financial performance, with the stakeholder theory, which is more appropriate in the analysis of the social aspects of the firm. Three main aspects are addressed: the analysis of the firm's social performance; the integration of agency theory with stakeholder theory; and the study of the specific characteristics of family firms' boards. The research confirms that neither the agency theory nor the stakeholder theo…
The monitoring role of female directors over accounting quality
2017
Recent research in accounting suggests female directors exert more stringent monitoring over the financial reporting process than their male counterparts. However, an emerging literature in finance and economics provides mixed findings and questions whether females in leadership roles significantly differ from their male counterparts. Building on this literature, we re-examine the link between the presence of female directors, gender biases, and financial statements quality. Using a large sample of UK firms we find that a larger percentage of women among independent directors is significantly associated with lower earnings management practices. However, we show that this relation disappears…
