Belgium case, the authors criticize the three fundamental arguments on which the decision of the European Court of Human Rights is founded: the approach based on ‘originalism’, the approach based on the Courts’ precedents, and the approach based on consequentialism. This contribution analyses the difference between the enforcement system provided for by the European Union legal system and the one set up by the World Trade Organisation. The reciprocal and bilateral nature of the WTO obligations and the possibility for the parties to a dispute to have recourse to negotiation (in ways not always foreseen and regulated by the Dispute Settlement Understanding) in order to resolve the issue of implementation in the post-adjudication phase of the dispute settlement procedure are features that by-and-large differentiate the WTO legal system from that of the EU and also explains the differences between the remedies provided for by the two systems.

The legal framework governing proceedings before the ECtHR does not deal with cases in which victims of human rights violations are not de jure and/or de facto capable of lodging applications with the Court. In the effort of overcoming such a procedural lacuna, the Court has established a test that, taking into consideration the extreme vulnerability of the victims (such as minors and persons with disabilities) and the seriousness of the alleged violations, allows NGOs to apply as their ‘de facto representatives’, provided that some other conditions are fulfilled.
