En este trabajo, presentaré una concepción de la ciudadanía europea, la que ha desarrollado Teodora (o Dora) Kostakopoulou, que es capaz a la vez de: 1) demostrar el carácter no natural sino artificial de la noción de identidad cultural y política, 2) evitar la trampa de ofrecer modelos de ciudadanía análogos a los modelos estatales, inaplicables a una institución como la UE, y 3) tener en cuenta los principios democráticos de inclusión y de participación. Since the nineteenth century, thanks to J.S. Mill, an argument against limiting the freedom of expression has been gaining ground, namely that the truth of an argument is the result of free competition between different ideas in a “marketplace of ideas” and that this competition can yield an approximate form of the truth or a robust argument. In this paper I will argue that Mill’s model of the marketplace of ideas is an “idealised” model because it assumes that there is a subject who seeks to know in a detached manner, without being influenced by his or her expectations, needs, ideologies, or biases. In questa nota intendo sollevare alcuni dubbi su uno specifico, ma non marginale, aspetto della teoria dei diritti fondamentali elaborata da Luigi Ferrajoli: il problema del conflitto tra diritti fondamentali. Inizierò con un argomento alquanto generico sulla presenza (almeno apparente, o potenziale) di conflitti tra diritti fondamentali nel panorama costituzionale contemporaneo. Quindi illustrerò la strategia elaborata da Luigi Ferrajoli per argomentare la tesi dell’assenza, o comunque dell’ambito estrema¬mente ridotto e marginale, dei conflitti tra diritti fondamentali. Infine, solleverò alcune critiche al modo in cui Ferrajoli affronta il tema del conflitto tra diritti.
