In this article, taking my cue from the insightful analyses contained in the book The Legacy of Pluralism, by Mariano Croce and Marco Goldoni, I reconstruct in outline Costantino Mortati’s conceptions of the law as a legal order and of the material constitution. I focus on the problems pointed out by Croce and Goldoni: the emergence of legal normativity, the problem of radical pluralism, and the role of jurists vis-à-vis politics. The chapter tackles the complex, tension-ridden, and often paradoxical relationship between relativism and conservatism. We focus particularly on radical conservatism, an early twentieth-century German movement that arguably constitutes the climax of conservatism’s problematic relationship with relativism. We trace the shared genealogy of conservatism and historicism in nineteenth-century Counter-Enlightenment thought and interpret radical conservatism’s ambivalent relation to relativism as reflecting this heritage. Misrecognizing Asylum. Causes, modalities and consequences of the crisis of a fundamental human right.

The so-called contemporary refugee crisis can be defined as a European “right to asylum crisis”, a crisis of its fundamental principles: the protection of asylum seekers’ rights and the related principle of non-refoulement. Modalities and trends marking the recognition of asylum applicants as refugees, and of migrants as asylum seekers, will be considered along with the current implementation of the notion of a “safe country” within the context of EU texts on migration developed since 2015. This “right to asylum crisis” is then briefly analyzed as both a symptom and a cause of the European Union project’s wider political and cultural crisis.
