L’articolo affronta i profili maggiormente significativi legati alla trasposizione della materia dei reati fallimentari dal r.d. 16 marzo 1942, n. 267, al d.lg. 12 gennaio 2019, n. 14, recante il nuovo codice della crisi d’impresa e dell’insolvenza. The article deals with the most significant aspects related to the transposition of the subject of bankruptcy crimes from the r.d. 16.3.1942, n. 267, to the legislative decree 12.1.2019, n. 14, bearing the new code of business crisis and insolvency.
Evaluating a Two-Level vs. Three-Level Fall Risk Screening Algorithm for Predicting Falls Among Older Adults

Background and Objectives: Falls account for the highest proportion of preventable injury among older adults. Thus, the United States' Centers for Disease Control and Prevention (CDC) developed the Stopping Elderly Accidents, Deaths, and Injuries (STEADI) algorithm to screen for fall risk. We referred to our STEADI algorithm adaptation as “Quick-STEADI” and compared the predictive abilities of the three-level (low, moderate, and high risk) and two-level (at-risk and not at-risk) Quick-STEADI algorithms. The Aristotelian reflection on the epistemological status of techne, and more specifically on the definition of rhetoric as a techne, can help us to rethink the very actual cleavage between theory and practice. A good techne, as the rhetoric has to be according to Aristotle, has not to choose between theory and practice, between the universal and the particular, but should be able to look simultaneously in both directions and to keep them together. We will try to show that may be worth to rediscover and to introduce the Aristotelian notion of techne into the contemporary epistemological and philosophical debate.

Con la sentenza n. 16253/2020 la Suprema Corte ha affermato che l’assenza di nesso causale tra la cessazione di un appalto e il licenziamento del lavoratore integra un’ipotesi di manifesta insussistenza del fatto posto alla base del licenziamento - con conseguente applicabilità della tutela reintegratoria attenuta di cui all’art. 18, comma 5, della legge n. 300/1970 - non riconducibile, pertanto, agli altri casi in cui il giudice dichiara risolto il rapporto concedendo la sola tutela indennitaria forte (da dodici a ventiquattro mensilità).

Con il d.lgs. n. 14/2019, che introduce il Codice della crisi d’impresa e dell’insolvenza, viene predisposta, per la prima volta in assoluto, una disciplina organica per i rapporti di lavoro coinvolti da una procedura concorsuale liquidatoria: la liquidazione giudiziale, che sostituisce il fallimento di cui al r.d. n. 267/1942 (l. fallimentare).
