The Role of Language Testing in the Migration Flow to the European Union
Human Rights and Changes to the International Legal System. Philosophical Reflections on the (Difficult) Coexistence of International Humanitarian La…
2012
Chapter 6 analyses the relationship between International human rights law (IHRL) and international humanitarian law (IHL). IHL represents the new version of a part of the old ius gentium, in particular its ius in bello. Nonetheless, IHL excludes ius ad bellum, formerly linked to ius in bello in ius gentium, in continuity with the Just War Theory. The current IHL is characterized by neutrality, impartiality, and humanity in protecting victims. The practice of IHRL – not the abstract doctrine of natural rights – aims to protect human beings in different contexts and against different forms of vulnerability. In this last sense, IHL could be seen as a part of the former in the case of vulnerab…

Femminismo islamico e cosmopolitismo
2021
The chapter introduces Islamic feminism as a movement with a focus on three study cases from Egypt (Omaima Abou-Bakr), Iran (Ziba Mir-Hosseini), and the United States (Amina Wadud). In my section, I claim that besides being a social commitment, Islamic feminism is a form of moral cosmopolitanism, for it is a global and transnational movement. The advocacy of Islamic feminists is rooted in local contexts, at the same time they are involved in empowering international networks which allow them to meet activists from other domains, enforce their projects, share their experiences and work together for achieving their goals. The name “cosmopolitan Islamic feminist” is not an oxymoron, since it d…
Alcune riflessioni sull’indipendenza giudiziaria nel contesto europeo
2023
This article aims to provide some reflections on the links between judiciary independence, the rule of law, and the role of judges both national and European. First of all, it focuses on the evolution of the role of the judge in the constitutional and European systems. Then, it shows how the European Court of Justice and the European Court of Human Rights have developed criteria to ensure the independence of judges, analysing them. Moreover, it examines the criteria that have been developed by the European courts and by the opinions of the Consultative Council of European Judges about the independence of the Judiciary Councils.
Is there a latin american child migration law? An analysis of the ‘Advisory Opinion n. 21 on the rights of child migrants’ rendered by the Inter-Amer…
2019
In 2014, in response to the request of the Southern Cone countries, the Inter-American Court of Human Rights issued an Advisory Opinion on the rights of migrant children in an attempt to emphasize the minimum guarantees that the countries of the region should grant to this category of migrant, especially considering their hypervulnerability when compared to adult migrants. Such request, made in the light of the growing migratory flow of unaccompanied minors in the Americas, has led the Court to point to a number of rights that should be particularly guaranteed, such as the right to seek and receive asylum, non-criminalization, non-detention, and non-return of minors, culminating in the desi…
Teacher training for Primary School defending diversity and inclusion. Memory of a case of teaching experience through Museari
2020
