The printing press played a major role in the emergence of an open science system. The Mertonian scientific norms reflect this openness. They also demonstrate, however, that science understands itself as a profession of certified experts. The openness of science was enabled by social closure. This paper analyses the current conditions and future challenges faced by the Third Sector of Social Action (TSSA) in Spain to consolidate itself as an institutional sphere of sustainable welfare and as a strategic actor in the development of social policies. Questo articolo intende contribuire al dibattito sulla legittimità giuridica di tale misura, esaminando i recenti sviluppi della legislazione in materia e le sue applicazioni in Belgio, Francia, Regno Unito e Italia.
