Les médecins étaient souvent appelés à intervenir en tant qu’experts dans les cours de justice de la ville de Valence à la fin du Moyen Âge. Ils étaient sollicités pour des raisons diverses et on attendait d’eux qu’ils rendent des jugements ou des pronostics. Un des cadres dans lesquels ils apparaissaient est la prison. La torture faisait partie du développement des procédures judiciaires en tant qu’élément destiné à prouver les faits, pour empêcher que le juge ait le moindre doute. Artykuł powstał z uwagi na przypadki spraw o zaprzeczenie ojcostwa, z jakimi autorka miała styczność w dotychczasowej pracy w kancelarii prawnej. Czas na wytoczenie przez mężczyznę powództwa o zaprzeczenie ojcostwa lub o ustalenie bezskuteczności uznania ojcostwa jest krótki i wynosi 6 miesięcy. Ponadto po jego upłynięciu jedyną możliwością z perspektywy ojca jest wytoczenie powództwa przez prokuratora, który de facto nie musi się przychylić do wniosku mężczyzny i może odmówić tej czynności. The institution of the Real Audiencia in the kingdom of Sardinia since the 1560s is part of a wider process which saw the rise and development of royal supreme courts of justice in several European countries of the early modern period. In fact, major State formation processes all around Europe required that monarchs increased their control on local authorities and that new increasingly centralised systems of judicial review gained precedence over all particular jurisdictions, feudal as well as municipal. Taking as a starting point the inadmissibility decision issued in 2019 by the European Court of Human Rights in the case Ahunbay and others v. Turkey, the article proposes some reflections concerning the possibility of lodging applications with the Court which are aimed at protecting collective interests and common goods as recognized (or emerging) under international law. The author traces the transition of the royal court of the Polish-Lithuanian Commonwealth to the Western European model of court ceremonies, which lasted for almost two centuries, from the sixteenth to the eighteenth centuries. Initially, they followed the ceremonial models of the House of Habsburg and, starting in the 1640s, the French ceremonial, refined at the Versailles of Louis XIV. On the 26th May 2017, the African Court on Human and Peoples’ Rights rendered its first judgement on an indigenous peoples’ rights case, dealing with the forced eviction of the Ogieks, a Kenyan hunter-gatherer indigenous community of approximately 20.000 members, from their ancestral lands in the Mau Forest.
