The study touches upon the theme of the relationship between condictio and actio in factum in the matter of innominate contracts. More precisely, the question arises whether the atio in factum could have performed a merely repetitive function, rather than lead to the protection of the negative interest. In this regard the author deals with Iul. 60 dig. D. 39.6.18.1 and Iav. 13 epist. D. 19.5.10, on the subject of donatio mortis causa and (quasi-)usufruct respectively. The research compares two texts of Justinian’s compilation: D. 28.1.20.2 (Ulp. 1 ad Sab.) and I. 2.10.9, that provide two different solutions to the problem if the father and the brother of an filius familias in potestate who makes a will de castrensi peculio can be considered testes idonei in his will. The author formulates questions on the reasons for this dissent under two different profiles: why, in the Institutiones, the Justinian’s compilers (probably, Theophilus) propose a determination, ictu oculi, opposite to that reported in the Digesta? What motivations justify the existence on the point of a probable dispute among the jurists?

The paper proposes a revised analysis of D. 10.2.7 (Venul. 7 stip.), from which it seems reasonable to suggest that Venuleius discussed a particular kind of co-inheritance: the coniunctim attribution of a hereditas or an inheritance quota regarding two heirs. The substantially classical text, which can be glimpsed therein, offers evidence of the coexistence of different patterns of co-inheritance in classical private Roman law.

The paper deals with the category of negotium in Salvius Iulianus. The author rejects the thesis according to which the jurist would have developed a concept of negotium as an objective relationship between two distinct assets. From the examination of Iul. 15 dig. D. 18.5.5 and Iul. 18 dig. D. 12.1.20 has rather taken shape the image of a jurist attentive to the will of the contracting parties, in the determination of id quod actum est.

Haec uocabula forsitan propria iurisconsultorum ueteris sermonis sunt (arg. ex Varro de ling. Lat. 6.61). Non est inverisimile quod Gaius (in Gai 1.141, 1.190, 2.103-104, 2.252) illorum uerborum pristinum ualorem resonat. The A. investigates the meaning of the terms ‘dicis gratia’ and ‘dicis causa’ in the legal sources. Probably these expressions belong to the ancient Roman legal lexicon (arg. ex Varro de ling.
