Negli ultimi tre decenni la cultura ha avuto un ruolo chiave nella costruzione delle politiche urbane, divenendo uno strumento decisivo nella definizione delle strategie di sviluppo economico e nell’accesso alla competizione globale che caratterizzano l’attuale regime di neoliberismo urbano (Miles e Paddison 2005). Within this framework Palermo and its historic center are no exception. The epicenter of these processes is represented here by the Kalsa district which since the early 2000s has been placed at the center of a precise strategy of culturally-based renewal called to drive the city's tourist renaissance (Vinci 2008). The culmination of this path came in 2018 when Palermo was named the Italian capital of culture and chosen as the venue for Manifesta one of the most prestigious traveling biennales of contemporary art. However the exponential increase in tourist arrivals in the last three years came to a halt with the outbreak of the pandemic which showed with unprecedented evidence the contradictions of the development strategies pursued in the historic center and the marks they leave on the territories. While this sudden interruption seems to offer an opportunity to radically rethink urban and cultural policies and find new curbs to the conditions of overtourism in which the historic centers of South European cities and beyond find themselves it could also prove to be an accelerator of the dynamics of commodification of these spaces representing the revival of tourism an easy escape route in times of crisis. The objective of this contribution is to critically explore the urban and social transformations that have crossed the Kalsa district of Palermo from the 2000s to the present using qualitative and quantitative techniques (analysis of statistical data in-depth interviews critical discourse analysis ...) with particular reference to the role that culture has played in these processes. Nel contributo in oggetto l'autore, muovendo dalla decisione delle Sezioni Unite della Cassazione n. 61 del 7 gennaio 2014, coglie l'occasione per riesaminare le vecchie e nuove problematiche sottese all’intervento dei creditori nel processo esecutivo. Il primo tema affrontato è quello della par condicio creditorum, che viene esaminata nella sua storia evolutiva dal Code Napoleon, al suo periodo di massima estensione, dato dal codice del 1940, fino al suo ridimensionamento a seguito delle riforme del 2005. The possibility in particular concerns those creditors sine titulo the where credit has not been contested (ex art. 499 c.p.c.) by the debtor seek payment and partecipate to distribution. In the last section the author examines the possibilities for other creditors to contest the intervention of the creditor sine titulo ex art. 499 c.p.c. (utendo iuribus in subrogation in case of inaction of the debtor) or in the distribution phase ex art. 512 c.p.c. He concludes that the only person that will be really damaged if he doesn’t contest - ex art. 499 c.p.c. - the credit it is precisely the debtor. On an individual level it constituted an area of identity investment when it assumed the shape of “sport spectacle” to be enjoyed fueling the practice of cheering and fandom or constituting the model of a winning lifestyleand the two ways of use can be strongly related to the perception and assessment of the quality of life. The “semantic universes” which however connote sport and “free time sports” have often appeared polarized. Commercial sport and sports professionalism are intertwined with the institutions of economics politics and culture which above all stress its “spectacularity” in order to capture first and foremost the audience. But also the sport of leisure time is intertwined with the actions of the institutions of economics politics and culture with the difference that these stress above all its “healthy value” aimed at the “healthy and rational” investment of time in an activity which improves the quality of life in the short medium and long period. This polarization between the consumption of sport entertainment - commercial sport - and the consumption of sport as a leisure activity - sport for all - has become increasingly interconnected precisely because of the increased collective identity demand via sport. In other words we have witnessed the spread of shape of sports entertainment that recall the importance of sports for psychophysical well-being for integration and social participation for the reduction of social inequalities ethnic and cultural differences and in which the importance assumed was weakened in the show from agonism from competition from the physical confrontation between two contenders or two teams. A sport in which we act with competitors as well as against competitors. Considering that it is difficult, if not impossible, for an analysis of Chopin?s music to unmask some aspects of his private life (such as an alleged sexual and affective attraction for individuals of his own sex), we can however argue that, throughout the 19th century, a connection was established between his work and a ?feminine universe.?
