Il presente scritto mira ad evidenziare taluni aspetti problematici della istituzione della IV Sezione del Consiglio di Stato nel 1889 e la valenza liberale della riforma crispina nel riportare le sorti dell’ordinamento italiano sulla via maestra del contenzioso amministrativo. Fu necessario un compromesso con la formale sopravvivenza della legge del 1865, che si fondava invece sull’opposto principio del monismo giurisdizionale, secondo la tradizione dei liberali francesi, come De Broglie, e del modello belga.
