L’articolo analizza in chiave critica la disciplina nazionale del subappalto nell’ambito delle gare pubbliche, così come recentemente riformata a seguito di diversi interventi normativi in ottemperanza alla procedura d’infrazione avviata dalla Commissione UE. The article critically analyzes the Italian regulation of subcontracting in the context of public tenders as recently amended by several legislative measures in compliance with the infringement procedure launched by the European Commission against Italy. According to the Author’s view the current legislative framework – characterized by the almost overall elimination of the previous limits (probably even going beyond what the European Commission requested) – lacks in finding a fair balance between the principle of the maximum participation in the tender on the one hand and the need to prevent and reveal potential collusive conduct on the other. Furthermore this conclusion is supported by the analysis of the regulation of the causes of exclusion from the tender still too timid in envisaging the optional exclusion of the participants due to anticompetitive conduct.

La tutela del lavoro nell’impresa sequestrata o confiscata tra contratto e mercato

Il saggio esamina il sistema delle regole che ineriscono la gestione della forza lavoro nell’impresa sequestrata o confiscata per metterne in luci pregi e criticità. La ricerca mette in particolare in luce i limiti della tesi che fa leva sulla prevalenza della disciplina contenuta nell’art. 56 del d.lgs. n. 159/2011 sulle regole generali. Il tema è indagato attraverso materiale giurisprudenziale in parte inedito e una valutazione critica del ruolo del sindacato.

The invention is related to the construction of a glassblock panel “dry assembled” that can be used to build translucent building envelope even in high-rise buildings. This panel is able to contrast the horizontal actions due to wind and earthquake by means of the application of unidirectional pre-stressing technique. To overcame the limits due to the “wet assembly” system traditionally used to assemble the glassblocks the use of prestressing technique allow the panels to have an adequate mechanical resistance against the actions perpendicular to their installation plane. In this configuration the mechanical resistance of the glassblocks is exploited. The unidirectional prestressing (along the prevalent dimension of the panel) is obtained through the grip of the nuts inserted in the steel bars that are housed inside the glassblocks supporting profiles positioned in the vertical cavities between the glassblocks and passing through the horizontal profiles useful to separate glassblock rows from each other. The proper nuts grip opposing to the steel plates positioned at the top and bottom of the panel allow to prestress the panel. Searches for heavy neutrinos from Z decays

We have searched for possible fourth family heavy neutrinos, pair produced in Z0 decays, in a sample of about 112 000 hadronic Z0 final states collected with the DELPHI detector. For all mixing matrix elements we exclude a new Dirac neutrino lighter than 44.5 GeV at a 95% confidence level, if the neutrino couples to the electron or muon family, and lighter than 44.0 GeV, if the neutrino couples to the tau family. Depending on the values of the mixing element and to which lepton family the neutrino couples, we obtain mass limits up to 46.2 GeV. For all mixing matrix elements we exclude a new Majorana neutrino lighter than 39.0 GeV, if it couples to the electron or the muon family, and lighte…
