Necessity of Protecting Religious Feelings under Criminal Law in a Democratic State
2021
Offending religious feelings, as referred to in Article 196 of the Polish Penal Code, was criminalized as follows: ‘Any person who offends the religious feelings of others by publicly insulting an object of religious worship or a place dedicated to the public celebration of religious rites shall be liable to a fine, restriction of freedom or imprisonment for a term not exceeding 2 years.’ This study highlights some doubts concerning the protection of freedom of conscience and religion using the example of the crime of offending religious feelings and attempts to prove the necessity of such protection in the Republic of Poland, a democratic state ruled by the law. The study first examines wh…
Tridentine reforms and the Sicilian Court of the 'Regia Monarchia': a jurisdictional conflict
2013
The Tridentine reforms met a real obstacle in the kingdom of Sicily, linked to the very particular religious-institutional system of the island, unique in the catholic European context. In Sicily, indeed, through a court called Regia Monarchia, re-organized by Philip II in 1579, the king exercised very wide ecclesiastical prerogatives, which went far beyond the simple right of royal patronage and greatly limited the power of Sicilian bishops. The Regia Monarchia jurisdiction was declared over the same Council of Trent decrees, making them virtually inapplicable for a long time. Indeed, as last instance of cases involving ecclesiastics, it often nullified the measures taken by the episcopal …
2014
In a city like Palermo, ancient capital of the Reign of Sicily, the effect of new religious complexes born from the catholic politic of the Counter-Reformation, was sudden and explosive, and it caused, between the second half of the16th century and the first of the 17th century, a process of urban renewal never seen before. The essay means to analyze, first of all, the architectural interventions from a quantitative point of view, so to render the real dimension of the phenomenon and of the role it played in the destruction of the medieval city and the creation of the modern one, triggering un uninterrupted state of conflict between the new religious settlements and the owners of the near b…
Obcy czy inni? Czesi w Zelowie
2018
We wstępnej części artykułu zostaną zaprezentowane kategorie OBCY, INNY oraz SWÓJ w różnych konfiguracjach (opozycja komplementarna, triada), obecnych w dyskursie tożsamościowym. 2010
William Penn, solicitor of the Quakers, and the interplay between legal and religious language
2008
English law is repeatedly referred to in the works of the Quaker leader William Penn, the founder of Pennsylvania and a great advocate of religious tolerance. A literary and linguistic analysis of the works of William Penn, therefore, can give a vivid, interesting picture of the religious debate which characterized the political arena in 17th and 18th century England, especially as far as legal, political and religious discourse and terminology are concerned. The first part of my paper deals with the importance of law for William Penn and among Friends, underlining how such relevance was given expression in 17th century Quaker literature. Secondly, it concentrates on the interplay between l…
2021
The historiographical literature dedicated to the architecture of the Friar Preachers in Sicily, if one excludes the few studies on the complexes in Palermo, which are anyhow focussed on the churches only, is still substantially limited to the sporadic studies by local scholars or members of the Order on the history of the Dominicans in Sicily. The aim of our research, therefore, was to outline a general framework that could serve as a stepping stone for further research. It was first of all necessary to carry out a census of all the Dominican architectural complexes in Sicily, in order to determine the overall dimensions of the phenomenon and its chronological and territorial articulation,…
