The housing emergency in Palermo between rights and legality
2017
This paper explores the dichotomy between interests and values in the field of the right to housing for homeless people, focusing on the informal practices of reappropriation of spaces (properties owned by the Municipality of Palermo) in the case study of Palermo. The experience we are dealing with here must be addressed in a wider context of structural and latent conflicts concerning the city of Palermo, which are streactly related to the emergency housing issue. Indeed, Palermo’s housing issue is a quite complex and articulated theme, where the ineffectiveness of public policies and the increasing of hardship and poverty conditions, exacerbated by the economic crisis of 2008, seem to find…

Problem ludzkiej godności w katolickiej nauce społecznej na przykładzie myśli Franciszka Janusza Mazurka
2020
2017
The study offers a philosophical analysis of Nicholas Wolterstorff’s theory of justice and education for justice. Crucial aspects of Wolterstorff’s theory are his understanding of justice as inherent rights and justice as inherent worth. Interrelated to this are the concepts of life-goods, well-being and the good life. Within this framework of rights grounded in worth, the notions of natural human rights and human dignity occupy a special position. These notions in turn form the philosophical foundation and implications for education for justice. The study is divided into two parts. The first part delves into the notion of justice as inherent rights. The key aspects addressed in this sectio…
Prawa człowieka w rzeczywistości globalnej wioski
2015
The area widely and loudly discussed, often raised in the public discourse is the topic of human rights. This topic is not new, it was already known in antiquity. Today it acquires a specific context of a shrinking global reality. As a result of computerization and media the world has become a global village, in which the events happening in the one place can at the same time can be reported in another. On the one hand we can see the cultural diversity and on the other there is a global diffusion of symbols and values. So does globalization help or impede the adoption of the same rights as fundamental human rights? Is the universality of these rights possible? Or perhaps cultural difference…

A New Technique for Implementing ECtHR Judgments: Will It Work? The Corte Costituzionale “Urges” the Houses to Reform the Ergastolo Ostativo
2021
In this much-awaited ruling (Order No. 97 of 15 April 2021), the Corte Costituzionale had to decide on the constitutionality of the existing prohibition on release on parole for life prisoners convicted for Mafia-related crimes, in the absence of any cooperation with justice (ergastolo ostativo). This form of life imprisonment without prospect of release had already been deemed in contrast with Article 3 of the European Convention of Human Rights (echr) in the judgment rendered by the Strasbourg Court in Viola v. Italy (No. 2): on that occasion, the ECtHR invoked a legislative reform of the ergastolo ostativo. In the order at hand, the Corte Costituzionale, instead of formally declaring the…
