In this brief intervention it is submitted that the emergency measures against COVID-19, adopted by the Hungarian Government, infringe the rule of law under the European Convention of Human Rights. First of all, these measures appear to be discriminatory, according to art. 1 of the Convention, insofar as they expressly aim at protecting only Hungarian citizens. Furthermore, they are not “necessary” under article 15, given that they extend to the « legal security and the stability of the national economy ». At the beginning of The Concept of Law Hart suggests a mistaken assimilation between conduct that is ‘non-optional’ and conduct that is ‘obligatory’ (i.e,. conduct that is either coerced or subject to an obligation). This suggested assimilation vitiates the argument of the whole book, leading Hart to neglect the different ways in which the law typically tracks, corroborates or constitutes power relations. It is true that, famously, attention is paid, in The Concept of Law, to normative, legal powers. Abstract: Along with Spain and United Kingdom, Italy has suffered a terrible period of political violence between 1970 and 1982 with hundreds of killings. In this paper I analyse the origins of Luigi FERRAJOLI’s theory of legal guarantee and his criticisms to Italian legislation against terrorism of that time. Therefore, I shed light on three different understanding of such a theory and I offer a review of that legislation that he labelled as «the subsystem of exception ».Moreover I will apply this conception of «special» criminal law to two famous trials against militants of a group of the extreme left. Usually, in jurisprudential debates what is discussed under the rubric of ‘neutrality’ is the claim that jurisprudence is (or at least can, and should be) a conceptual, or descriptive - thus, non-normative, or morally neutral - inquiry. I discuss neutrality in an altogether different sense, namely, neutrality as an ethico-political ideal the law should meet. My starting point is normative legal positivism, or the claim that it is a good and desirable thing that the laws have easily identifiable, readily accessible, as far as possible non-controversial social sources. The article discusses two main theses. The first one is the presence and forms of the rule of law in the international legal scenario. This task is developed through the analysis of three possible versions: the extension of the domestic rule of law to the obligations coming from international law, the rule of international law, and the international rule of law.
