Praca prezentuje w pierwszej kolejności zagadnienia związane z pojęciem umowy franczyzy jako empirycznym typem umowy, jak i teoretyczne zagadnienie problematyki umów nienazwanych. W kontekście treści stosunku prawnego franczyzy zwrócono uwagę na dwie kwestie. Po pierwsze, pomimo braku regulacji umowy franczyzy w polskim prawie cywilnym wpływ na treść stosunku prawnego franczyzy mają przepisy prawa publicznego z zakresu ochrony konkurencji (prawa antymonopolowego). Wpływ ten należy ocenić jako istotny.
