Peace Mediations: Recourse to the Arbitration in the kingdom of Valencia (XIV-XV Centuries)

Arbitration, as a means of conciliation, had an extraordinary diffusion in the Medieval West. It had the advantage of being more quick and, generally, less expensive that the causes resolved by the ordinary courts. Moreover, it tried to reconcile the interests of the warring parties. This paper seeks to define the main features of the arbitration in the kingdom of Valencia during the Middle Ages focusing the observation on the small rural community of Vilafranca.

One of the main principles of arbitration is that the arbitral tribunal must be independent, impartial, neutral and diligent in carrying out its duties throughout the arbitration proceedings. There are a limited number of post-award remedies available, the annulment mechanism being the only plausible way to challenge the award. The annulment provision, Article 52, allows challenging the award with regard to the procedural matters only. The most frequently ground for annulment is “manifest excess of powers” as listed in the said provision. However it is not identified what errors of a Tribunal fall within this ground, as well as there is nothing about applicable law and jurisdictional matters in the provision. Conciliation is not required prior to arbitration by the President of the Bar in case of a dispute between French lawyers

In two decisions of the First Civil Chamber dated 8 March 2023, the French Cour de cassation indicated that, even though articles 7 and 21 of the Act of 31 December 1971 and article 142 of the Decree of 27 November 1991 referred to conciliation prior to arbitration by the President of the Bar, it was not compulsory. Non-compliance with this requirement cannot therefore be sanctioned by a dismissal.
