The paper deals with the structural vagueness of the legal measures enacted by the Italian legislator to manage the Covid-19 pandemic. Can we demand more certain norms? Is personal liberty taken in due account by the legislator? Starting from these and similar questions, the paper proposes a reconstruction of the law and of the underlying legal ideology of contemporary constitutional States. Unlike the modern State, which was characterized by the authority principle and the value of legal certainty, the contemporary constitutional State seems to be willing to sacrifice authority and certainty on the altar of more justice and flexibility.

According to some comparative studies, contemporary nation states exhibit an apparently impetuous worldwide general convergence toward the establishment of independent regulatory authorities (IRAs) with regard to a wide range of policy sectors (§ 2). In the Italian political system of the so-called First Republic (1948-93), the widespread attitude towards independent regulation used to be unfavourable. This paper deals with the problem of the maintenance scheduling in a multi-component system for which a required reliability level has to be warranted until the next planned stop for maintenance. Particularly, the tackled problem concerns both the determination of the elements set on which to perform preventive maintenance and the optimal number of maintenance crews in order to warranty the required reliability level at the minimum maintenance cost. Stylistic Fronting is a phenomenon that has been intensively studied with respect to the symmetric Germanic Verb Second languages: Old/Modern Icelandic, Old/Modern Faeroese but also Middle English and Modern Yiddish. Standardly Stylistic Fronting is seen as an operation that moves an element in front of the finite verb in order to rescue the verb second constraint, in sentences that contain a subject gap.
