The first part focuses on the principle of personal autonomy and the rights to health and to life for patiens who lack capacity, as enshrined in Italian legislation. AIDS is a clinical picture related to Human Immunodeficiency Virus (HIV) infection. In the last 20 years this infection has spread progressively, with approximately 2.4 million children under 15 years old now infected. The HIV antibody test is generally used to reveal the infection. In most European countries the test is voluntary; in Italy, implementation of the test is now regulated by Law 135/90. Art. 5 of the law states that the test is voluntary while informed consent is obligatory. However, nothing is stated concerning the child's consent. In DH v. Czech Republic (2007), the Czech government argued that Roma parents consented to the assignment of their children to ‘special’ schools. According to the government, parental consent undermined the claim that the disproportionate assignment of Roma children to inferior schools amounted to discrimination. Cette contribution s’inscrit dans le cadre de la présentation de la complexité juridique de l’inceste consenti. L’accent est mis principalement sur le droit pénal allemand. Néanmoins, des parallèles avec le droit français seront réalisés. A l’aide de cette participation, il est permis une comparaison entre les droits pénaux français et allemand.
